You can opt out of allowing us to collect this information through the settings on your device, either by refusing access to the information or by disabling location services. However, if you choose to opt out, you may not be able to use certain aspects of our Services. For example, our site may be unable to automatically offer you pricing in the currency of your country of residence.  We may also infer your location based on your IP address, using this information for similar reasons.

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, such as with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.

  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
  • Develop and display personalized and relevant advertising content for our users.
  • Analyze how our Services are used so we can improve them to engage and retain users.
  • Support our marketing activities.
  • Diagnose problems and/or prevent fraudulent activities.
  • Legal Obligations. • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

If you are located in the US, this section applies to you.

The United States has various privacy legislations, including federal laws and state-specific laws such as the California Consumer Privacy Act (CCPA), which require us to disclose the legal bases we rely on to process your personal information. Accordingly, we may rely on the following legal bases:

Consent: We may process your information if you have given us explicit permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time, which may affect the availability of certain services, by contacting us at [email protected]

Performance of a Contract, Legitimate Interests, Legal Obligations, Vital Interests: As detailed in the preceding sections, these legal bases also apply to our processing of personal information of US residents.

In some exceptional cases, we may be legally permitted or required under applicable law to process your information without your consent, including, for example:

  • Protecting Life or Safety: If it is necessary to protect an individual’s life or safety and consent cannot be obtained in a timely manner.
  • Investigations and Fraud Prevention: For investigations and fraud detection and prevention.
  • Business Transfers: In the course of a sale, merger, or transfer of all or part of our business, provided certain conditions are met.
  • Legal Compliance: If obtaining consent would compromise the availability or the accuracy of the information, and the collection is necessary to investigate a breach of an agreement or contravention of federal or state laws.
  • Legal Proceedings: If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.

If you are located in Canada, this section applies to you.

We may process your information with your consent or as otherwise required or permitted by law.  In some cases, we may seek your explicit consent to use your personal information for a specific purpose.  Otherwise, we rely on your implied consent to the processing of your personal information as set out in this Privacy Policy. By doing business with us, visiting our website, entering one of our contests, or otherwise corresponding or communicating with us, you agree to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.

You can withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. You can withdraw your consent by contacting us using the contact form or submitting a request through [email protected].

In some exceptional cases, we may be legally permitted or required under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way.
  • For investigations and fraud detection and prevention.
  • In the course of a sale or transfer of all or part of our business, provided certain conditions are met.
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Search and Social Media Advertising.  As noted in the section below, we may use services provided by third-party search and social media platforms to serve relevant Company advertisements on such platforms to you and others.

To do this, we may provide to the platform a hashed version of your email address, IP address or other potentially connecting information, which the provider will attempt to match to a profile you may have with that platform.  Hashing is a mathematical operation that applies an equation to information so as to produce an encrypted value that cannot be reversed to reveal the original data.  Both Company and the platform run the same one-way hash function on the same data element, for an example, an email address. As a result, when Company provides the platform with the hashed email addresses of a selected group of Customers, the platform is able to match the hashed value against the corresponding hashed value for users of the platform, allowing the platform to target Company customers that are users of that platform with relevant advertising, based on demographic factors selected by us, or to assist the platform in identifying platform users displaying similar demographic factors, to which we may direct advertising on that platform.  If you do not have a profile with that platform, the hashed identifier is meaningless to the platform.

For further information about this process, the platform’s use of your personal information, and your options for managing those uses, please consult the privacy policy and related documentation of the platforms to which you are registered. To opt-out of the use by Company of the personal information we hold about you for such purposes, you may contact us at [email protected]

  • Legal Requirements.  We may also share personal information with third parties as required or permitted by law, such as:
    • to government bodies and law enforcement agencies, pursuant to warrant, order or statutory requirement;
    • in connection with any legal proceedings or prospective legal proceedings involving Company;
    • to otherwise establish, exercise or defend our legal rights (including providing information to third parties for the purposes of fraud prevention and reducing credit risk, as permitted by law);

Company does not otherwise share, give, rent or sell personal information to any third parties, unless additional consent is obtained.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

When you visit our Site, we may use certain automated tools to provide you with a more personalized browsing experience, better understand your needs, provide you with content that is most relevant to you and monitor trends respecting the usage of our site and apps.

Cookies

One such technology that we use are called cookies.  A cookie is a small data file that is sent to your browser from a web server and stored on your device that identifies your browser/device/IP address (but not you as an individual) to our computers each time you visit our Site.

We use cookies on the pages of the Site where you are prompted to log in or that are customizable. If you have previously registered with our Site, these cookies (1) may let us know who you are, (2) may be necessary to access your account information (stored on our computers) in order to provide personalized services, and (3) will provide us and our service providers with information that we will use to personalize our website in accordance with your preferences and interests. As outlined below, you may set your Web browser to notify you when you receive a cookie or to not accept certain cookies (these controls are typically found in the privacy settings for your browser). You do not need to enable cookies to visit our Site; however, if you decide not to accept cookies from our website, you may not be able to take advantage of all of the features of our website.

Tags and Pixels

Our Site may also use a technology called “tracer tags”, “web beacons” or “tracking pixels”. These are small transparent graphic images that allow us to record simple user actions related to our Site and to email communications received from us, to help us determine the usage and effectiveness of our Site and email communications.  These “images” are automatically loaded to your browser/device when you visit the Site or open an html format email message from us, thereby letting us know if a certain page was visited or an email message was opened. This technology allows us to understand which pages you visit on our website. This technology is used to help us optimize and tailor our website for you and other future visitors to our website.  These may also be used by third party partners, such as social media networks, who use the technology to measure the effectiveness of the ads we place on such networks.

Use of Tracking Technologies

Using cookies and tracking technologies, we may collect personal information in a number of ways.  For example, we may collect information about your IP address, user-generated data from cookies (e.g. clicks, displayed page, page visits, time spent on the page, products displayed and clicked, orders, average order value, how you access and exit the Site etc.), approximate geographical location, and technical data (e.g. type of device, browser settings, time zone, operating system, platform).

We analyse this information at an aggregate and pseudonymized level for statistical purposes, and for optimisation of our Site to market our products and brands, such as by analysing which parts of our Site are visited most often, and similar metrics.

If you visit the Site and consent to our cookies for personalized advertising, we will use the data collected, for targeted advertising on third-party social media and search engine platforms such as Meta, Google, YouTube, etc. The purpose is to present you with advertising targeted at you based on your behaviour and browsing patterns, based on your interaction with our Site and the data collected about you by the operators of those platforms, at specific points in time and locations for these platforms to increase the effectiveness of our advertising campaigns.

As noted in the previous section, some limited personal information may be shared with such third parties to target advertising on their platforms.  They will try to match your profile in their database to determine the optimal time and location (the page on which you are browsing) to display an advertisement from us, or to identify other users of those platforms to whom we may want to target ads on those platforms. Third party platforms also use tracking technologies to identify when a user of their platform has visited our Site after being presented with one of our advertisements on that platform and provide us with reports to that effect.  This allows to assess the effectiveness of our advertising on those platforms. If you do not accept that we track your data for this purpose you can still see our advertisements on other platforms randomly.

Your Choices

For more information about interest-based advertising on your desktop or mobile browser and to understand your options, including how you can opt-out of receiving behavioural ads from third-party advertising companies participating in the DAAC, please visit the Digital Advertising Alliance of Canada website.

We may also use a third party such as Google Analytics to help us gather and analyze information about the areas visited on our site (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the convenience of the websites. For more information or to opt-out, see Google Analytics help page Safeguarding Your Data (External) Some of these tracking tools are used only for purposes necessary for the operation of the Site such as to ensure access and stable operation of the Site.

However, you may control the setting of cookies in several ways:

Please note that our website does not provide a direct method to manage cookie settings through a footer link or other site functionality. The primary way to manage cookies is through your internet browser settings. Through your browser, you can reject or delete cookies, depending on your preferences. Additionally, you can opt out of the use of cookies for behavioral advertising and tracking as outlined above. These cookies can be session cookies (which will be automatically deleted when the browser is closed) or persistent cookies (which will remain stored in your device until their expiration date). If you prefer not to manage cookies through your browser, we recommend not browsing our site.

6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

If you are accessing our Services from outside the United States, and Canada, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see “WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?” above), in other countries, where it will be subject to the laws of the jurisdiction in which it is stored or processed.

While we will take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law, the local laws of the countries to which your personal information may be transferred will apply.  While we consider local laws in our decisions to transfer personal information internationally, you would be aware that these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country.

For further details regarding our practices under the CCPA or to request a copy of our data handling protocols, please contact us using the information provided in our Privacy Policy.

If you are located elsewhere:

We will use contractual and other means to provide a comparable level of protection while your personal information is being processed outside of your home country, including requiring that the information be protected using appropriate security safeguards, limiting the recipient to using your personal information solely to provide the Company with the specific service for which those providers were engaged, and for no other purpose.

No purpose in this notice will require us keeping your personal information in our active databases for longer than the period of time in which users have an account with us.  However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms or as otherwise required or permitted by applicable law.

When we no longer have a legitimate business need to process your personal information, we will either securely delete/destroy or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in unstructured backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
